2101 yet again, serious problems with this loco. Mr rail regulator will not be impressed. Maybe PN will sell her off cheap: as is where is!

How long did 2101 last in service before she went "bush" again, 3 weeks?

These derailments do (at least in my mind) pose some interesting questions about liabilities under the current "track owner", and "rail operator" setup.

Under the old system where PN managed track and rolling stock as one entity you can only imagine that the cost's associated with a derailment were contained in house, BUT now say if the track was found to be the cause of the derailment would "WE" (Tasmanian tax payers) be required to foot some or if not all the clean up and repair bill....

Could a rail operator sue the state for costs if it were found that a track malfunction caused the accident?

Could the state sue a rail operator for damage to the track caused by a certain locomotive (that's painted blue and yellow and has 2101 on it) continually jumping off the rails?

Would someone like Boyer / Nystar be able to recover a $$ figure from the state if the track was found to be at fault and that resulted in product being damaged or a delayed delivery.

I think in a road sense, if you say, hit traffic light, and your proved to be at fault the state can try and recover costs...

I think the answer is pretty simple. If your at fault you are liable.

Well, what was the Rail Regulator's out come on ZR2101's derailments?
Also, have they ever thought of putting a different set of bogie's under it and see if the derailment's still happen.

As for the comments Mr Woo, that is an interesting scenario. I suppose the rail operator could sue the government over track conditions. Also, if i was a user of the rail network and my stock was damaged, i would ask the hard questions to PN and the government.

Given Pathetic Irrational's current track record (excuse the pun Rolling Eyes ), the fact that the Tas Gov has only recently taken ownership of the track, the same track that PNT previously owned and failed to keep in a satisfactory condition, and that PNT are going to p*** off in a couple of months anyway because "it's too hard"...

I would assume PNT wouldn't have a chance. Laughing

But if freight on that train was damaged or the derailment caused significant financial penalty to the customer, then yes, I would be seeking some sort of compensation.

I think from memory there have been four, five (?) derailments this year? Certainly it's the second derailment in a month. Shocked How many has ZR2101 been involved in?

Have lost count, thinking around 4 - 5 involving 2101? I can recount 3 of them, but has been more than that.

it also came off at between boyer & b/water. but now i think about it, that may have been before it got its rebuilt bogies. So may be only 4.

not sure mate, just saw it sitting outside the quickfix on sat. Might depend if they can work out why it derails or not. maybe they could melt it down for metal for the new bell bay bridge Idea
