I don't doubt it. When I meantioned calling his bluff, I mean't the part about me setting up a website & hosting his content, NOT the part about him 'walking away' from MSTS (although he seems to be "within millimeters of doing that anyway" before I even joined the debate). I wou;dn't want to see anybody remove files from their website for trivial copyright matters.
Let me also say that I am not having a go at anybody here, if anything I'm trying to give him (& others) moral support.

Alright blakjak I'm calling your bluff, go and get off your a==e and set-up your own website but don't use Steam4Me's content, design your own, design your own webpage, do the work and design your own installer instead of using someone else's work.
We can and we do investigate anyone and everyone.
We do not normally get involved until after civil action has been completed and a report is sent to us by the courts.
The companies don't call for an investigation they take civil action agianst the offender and it is not always for monetary compensation but sometimes to gain a "cease and desist" order against the offender.
There have been several successful prosecutions against T-Shirt manufacturers here in Australia and several containers of T-Shirts that were made overseas siezed and destroyed with the importer prosecuted for breaches of the law.
You don't know what you are talking about "loss of income". If you release a product that has say a beer brand on a T-Shirt that is detrimental to that company then they can sue you.
Yes I do enjoy my job, it helps to get rid of parasites that bludge on the rest of the community.
So go to work blakjak and set-up your website and don't worry about "trivial copyright matters" and it will give me the greatest of pleasures to visit you in Sydney (Redfern Area) with the Federal Police

Done & done. You want a link? Nah, your the big investigator, find it yourself (hint hint, it has nothing to do with trains & the server is off-shore).
It's good to see you get pleasure out of things like this, at least now we know some of your motives.
PS: Cops & 'copyright investigators' (for lack of a better term) don't scare me, if your gonna threaten me, do it properly.

Hi,
first post for a while, I think.
Alltrains - I am calling your bluff.
There is no record of a Russell Watts having ever worked at the Attorney General's Office here in Canberra. I have verified this by two distinct means.
I took the liberty of contacting the director of the copyright law centre, (who has also never heard of you, by the way). The director has given me permission to provide the following information from the Attorney General's Department (AGD):
| Quote: | The Copyright Law Branch in the Australian Government Attorney-General's Department (AGD) has responsibility for the Copyright Act 1968 and copyright policy in Australia. We advise the Australian Government on copyright law and policy. We also provide general information about copyright on our website: We advise the Government on copyright law and policy.
We also provide general information about copyright on our website: http://www.ag.gov.au/www/agd/agd.nsf/Page/Copyright
AGD does not have investigation officers involved in investigating piracy and breaches of copyright.
We do give permissions for reproduction and use of Commonwealth copyright material and may get involved where it is the Commonwealth's copyright that has been breached, but do not have any general investigative function.
There are both civil remedies and criminal offences for breaches of copyright. In relation to the former it is up to the copyright owners to undertake their own investigations and take civil action. For more serious breaching activity (generally where the person is profiting in some way from their breaching activity) it is a matter for the police (State or AFP) to investigate and for the Commonwealth Director of Prosecutions to consider prosecution.
There are various industry bodies that do investigative work in the copyright area and assist police on more serious matters - eg: Australian Federation Against Copyright Theft: http://www.afact.org.au and
Music Industry Piracy Investigations http://www.mipi.com.au
There is some misinformation in the 9/11/06 post by Alltrains, particularly regarding term of copyright.
The general rule as of 1 January 2005 is that the term of copyright is 70 years after the end of the calendar year in which the creator died. Further information on this issue is at: http://www.ag.gov.au/www/agd/agd.nsf/Page/Copyright_Howlongdoescopyrightlast
In relation to 3-D models there may be overlapping issues between copyright and design law.
There were signficant changes to the Copyright Act in 2005 to implement the Australia-United States Free Trade Agreement - http://www.dfat.gov.au/trade/negotiations/us_fta/outcomes/08_intellectual_property.html
and in 2006 to strengthen the enforcement regime -
http://www.ag.gov.au/www/agd/agd.nsf/Page/Copyright_IssuesandReviews_CopyrightAmendmentAct2006
|
I have bolded a section for emphasis.
My enquiries have also led me to believe that each state Attorney General does have a small copyright section, but that they are primarily involved in licencing the use of copyright held by the state or territory - not in investigating copyright abuse or privacy.
It's quite obvious to me that you are a liar who has misprepresented his position as being an official one, thereby bringing the government into disrepute.
Naturally this undermines the weight of your arguments on copyright, most of which are pretty damned silly anyway, if you have any knowledge of the act or it's application.

Coincidentally, you appear to have done a great deal of damage to the trainsimming community in Australia. If I were a moderator at this site, I would be banning you immediately and considering legal action for fraud.
I am a moderator at UKtrainsim.com and have banned you from that site with immediate effect. I will be communicating this message to trainsim.com as well.
As you have affected the enjoyment of so many trainsimmers, not the least of which is Yuri Sos, I feel that it is right and proper that your own enjoyment be curtailed.
Yuri has my contact details, if anyone wishes to check my bonafides.
Regards,
Mike Wilson

As far as I'm concerned the died over a year ago. If you still have a problem, take it up with the relevant parties via PM.
