Only if it is it up to the current standards of payware(and the 3d modelling program EULA permits it). This includes new trees/vegetation, custom terrain textures, a new track texture, documentation and detailed activities, full siding/platform detailing, accurately laid track and roads (No more than 5 - 10 metres out), most buildings have to be custom made, extensive detail all over the route that you often do not get in a typical freeware route. Seasonal/night textures, very accurate buildings/bridges for the period, and if time permits then some rollingstock. The "make it payware" notion is hardly as non-time consuming as it sounds.
I'm not pretending to be any expert on this, this is just the precedent made by one particular US payware franchise whose forum I visit quite regularly

As ARG706 rightly points out the extra work involved and the extra documentation needed as there are items used that are designed by other people and allowed to be used with their permission as long as the release is freeware, but with that aside even as payware it does not stop people like squeekazoid from stealing any of the work that has been done and re-skinning it and releasing it as his own work as he has done before. This main reason that I will not be releasing any of my work is so that people like squeekazoid cannot get their grubby, theiving hands on work that has taken over a year to do by me and my friends and have him claim it as his work.

Alltrains: I have only one simple tip. Create a readme file. That way, you can say that the route is for PERSONAL USE ONLY and that NO MODIFICATION OR REDISTRIBUTION of the route may be allowed and no objects that are in the route are to be taken from it and modified, or legal action will be taken against the offender. You hear us Squeek? RTFM! or RTFR more like. Unless squeek's too stubborn and corrupt to read it. Then you should quit the MSTS scene all together so squeekman can't get to you.
thewizkid93: The melbourne railway project is a REPLICA of a line with many copyrighted buildings and stuff, and the only way to obtain copyright for something is to PAY FOR IT, 60 dollars, or possibly even more. That's the problem.
If you still want to withdraw the project, Alltrains. Then mods, this thread has no more use. Please lock, but ONLY if Alltrains says he'll stick to withdrawal.

My answer is get off the forum and take your toys with you. Not only that, but complain to the mods that this jerk did not read the *BLEEPIN* readme and has started to modify MONTHS, (or even YEARS) of your hard work, if you released something, if it's someone else's work that the person has vandilised, complain still that this guy didn't read the readme and hasn't obtained permission from the creator. If that doesn't help and he's still going. Then Legal Action should be taken against him. Get the cops onto him for trespassing or other kinds of stuff in whatever location their in if they're bad people.
Basically, just quit, take your toys with you, and PM the offender saying how much of a hole he/she really is and hope that he/she will get their comeuppance so they can feel bad! And take action!!!
