Oh freaking heck J515, a true modeller keeps making MSTS models freeware/payware, and if they STOP and just, give it to "good" people, then that is smeg, they don't model MSTS trains for the right reasons. Matt Austin said he had the 500 class diesel Big Ed gave him. BIG DEAL, it's probably becasue it's in need of improvements, beta testing, etc. That is my opinion, and none of you have to follow it, I do..

Honestly kid, who makes you the one that determines who is a modeller or not? I could go now and make a model of some sort of loco and when finished, give it to whoever I want - whether it be the entire world or the guy next door. I would still consider myself a true MSTS Modeller as I would have accomplished what many still havn't done (including myself)
Just because I wouldn't give it to you because you want evidence of its existence doesn't make me any less of a modeller than any other person that builds models. You try to differentiate yourself from Sqeeakzoid or paynos, but to me your exactly like them: expecting everything to be given to you and if it isn't given to you then the person is somehow less important in the community according to you.

Oi. Don't tell me what the reasons I model MSTS for are. I don't model MSTS stuff for you, or anyone else in the general public. I do it for myself. I do it for my own enjoyment. It just so happens that some of the stuff I build ends up available for download. I can tell you now though, there is a smegload of stuff that I have built and never bothered to release simply because I built it for myself. If I didn't do it for my own enjoyment I wouldn't model at all. It's not a job, I don't get paid for it. It's a hobby.
So yeah. loose the indignant attitude, and don't try and make judgements on who is a "true modeller" or not.

Your are actually right, Alexander, people do build models for themselves, I realised now what a true modeller is, everyone's a true modeller, if theyr'e a modeller, they build stuff for their OWN ENJOYMENT, and not for others unless they want to, the same goes for reskinning, becuase I have reskinned some rolling stock for my own enjoyment, and I don't plan to release some of them, but some I will so others can enjoy it.
I terribly apologise for this, and I hope this won't happen again, becasue I was seriously smegged off at big ed for his quit on freeware. I'm sorry..

There's no reason to be smegged off at big_ed, as you put it, because in the end its his decision as to whether or not he releases freeware models. If he only chooses to give his creations to a select few then so be it.
Attitudes like yours drive a lot of brilliant model builders away from MSTS.

Though regrettable, your position is fully understandable. With SAR_Fan leaving the fold, the fallout from a number of recent ill thought out posts is taking a toll on our small community of creators.
As a consolation [sic] we now have squeekazod stepping up to the 3D modelling plate. Using his current work as an indicator of things to come there is no way his feet are going to fit your Ronald McDonald shoes.
Your (and others) raising of the bar in respect of quality 3D models is what has spurred me to try and lift the standard of my models. This in turn increases my skill levels in a number of disciplines and for that I thank you.
As for your avatar I’m sorry to see the last one go. There was something about that smile. Though in bad taste, I was going to suggest that you could have modified it by rotating the tie by 180 degrees and cocking the head over to one side.

Guys
I have watched and read the posts over recent weeks with deepening concern. The things that have been done (ie those who created the situation) and things said in reaction have caused a massive amount of damage to the MSTS Community. Unless they are addressed promptly, the hurt will continue for months, even years.
I am a route developer with around 12,000 downloads for Version 1 and Version 2 due in a few weeks.
I have invested over 5,000 hours in the route and have built something over 1,200 custom items for it.
Therefore, I have an investment in copyright that is greater than most of you. Therefore why should I consider releasing this while there are those who will openly abuse copyright?
I have asked Railpage Australia™ where they stand on copyright. They have declined to answer
I have asked Steam4me where they stand on copyright. I have not had a reply.
Therefore, until I have assurances fom
1. Railpage Australia™,
2. Steam4me AND
3. those who openly breach copyright
maybe my 5000 hours of work will be shared only with people I trust.
We all know who started this and the rantings continue even in the face of threatened legal action. I am also considering my position in this.
Bottom line - there have been numerous (repetitious) deep apologies - if you do not say it in the first place, you never have to apologise!! Think about it!
So, Administrators and users, start applying some maturity and control and lets bring this stupidity to an end before any more damage is perpetrated!

You know very well my attitude to copyright breaches.
As for Yuri and the rest of the guys at team-ALCO I can assure you that
we treat it seriously and support you querying railpages position on this.
I'm sure all the guys will not mind me answering on their behalf on this issue.
Someone mentioned here a while ago (might have been superheated steam ) that to produce MSTS content you are going to cop the crap from the idiots.
This is the main reason we are losing the good guys like Troy.

Allanl. Thank you for bringing up the subject of copyright. I know that big-ed is smegged of at me but I believe that he misunderstood my post thinking that I was in support for what squeekaziod was doing. I would like to explain my stand and why I take it.
I am an investigation officer with the Attorney Generals Dept involved in the piracy and breaches to copyright. I am also a train simmer involved in building a route myself.
Now as the copyright law stands anyone who designs a route does have their design automatically covered with copyright and at the moment this copyright is valid for 50 years.
Now anyone who does a 3D functuanal model of any item that is a replica of any real item that was designed by any other organization or person must obtain written permission from the original copyright owner. At the moment copyright has a life of 50 years which means that anything that was designed before 1956 the copyright has expired but anything after 1956 the copyright is still valid and enforcable
I will use a previous post as an example and I hope that everyone will understand the problems that can come out of this situation.
squeekaziod did a re-skin of a CL class and changed it to a CLP of ARG livery he used a 3D model that was built by someone else and the texture in ANR was done by someone different.
Now as the CL and CLP are in real life built by EMD and the design is less than 50 years old then the copyright owner is EMD and not the 3D model designer. So unless the 3D designer has written permission from EMD then he is in breach of the copyright laws and being an individual he is liable to a fine upto $60.500 or 5 years imprisonment or both but if it is done by a corporation the penalty is multiplied by 5. Also the person that has done the original texture on the model must have written permission from ANR as their colour livery also comes under copyright and come under the same penalties. Now with squeekaziod it is different as he has changed the model from a CL to a CLP so therefore he must have written permission from EMD for the CLP and he has changed the livery so he must have written permission for ARG for the use of their livery. He is liable to double the penalties as the previous two people.
All it takes to obtain written permission is to contact (email, telephone, letter) the copyright owner and explain to them what you are doing and also inform them that you are doing it as freeware and not for financial gain but if you are doing it for financial gain then there is a good possibility that they will charge you a licence fee.
I would suggest that anyone how has done a 3D model of a design that is less than 50 years old that they contact the the original copyright owner and obtain written permission to use their design and the same goes for those who have used various liveries.
Now you can design and build anything for your own use without breaching the copyright laws but if you give one copy of the product to anyone them you are in breach of the copyright laws.
I only hope that this clears up some of the problems that have been around on some of the threads on Railpage Australia™.
As I said in one of my previous post before you threaten anyone with legal action for breaches to copyright make sure that your own backyard is clean as an investigation will look at who has the original ownership of the copyright.
