Sorry Marek and Yuri I was part way through your answer but was interrupted by a PM in brief the 70 years has only come in recently and the website had not been updated hat is why I said 50 years, but Microsoft do have to get permission to duplicate all the airports that they use in their Flight sim and any other buildings that still have an active copyright, failure to do so would cost Microsoft millions of dollars in fines and they would have to remove the item from Flight sim. An airports design comes under one single copyright as the design is for the layout and the buildings all in one so there is only one permit needed. example if you want to model Melbourne Airport then you apply to the owner of Melbourne Airport for permission which includes everything that is inside the boundary of the airport. With the likes of the R class as the 70 years has only just recently come into force and it was 50 years before then the time only goes back to 1956 as that was the date 50 years back before the change to 70 years so we can not go back any further as that would involve items that the copyright has already expired so it works like this now an item is designed in 1956 instead of the copyright expiring 31 December 2006 it will expire 31 December 2026, so as all the steam locos in Australia were designed before 1956 none of them now carry a copyright, they are all in the public domain for anyone. When Model Dockyard first produced the NSW 38 class they were required by law to have permission to produce it as it was inside the 50 year time frame. Normally any company who produces these type of models do obtain licences to do so. An example of this is a case I worked on not long ago where a company modelled a Boeing 767-300 painted in various airline liveries, we received a complaint from one of the airlines who claimed that the company did not have approval to use its livery, on investigation it was found that the company had approval from Boeing to produce the aircraft but did not have approval from any of the airlines to use the liveries, all but two airlines said no problem let them use it but two airlines said NO and proceeded with legal action. The company was fined $250000 and the models of the aircraft with those two liveries on were confiscated and destroyed. One of the airlines has a flying kangaroo and the other has a gray livery from the asian area (now just remember I have not named the airlines) The one with the flying kangaroo wanted $40000 for the licence to use its livery and the other would not release its livery.
Just one more thing if you are doing advertising signs for your routes don't use the flying kangaroo because they will find it and the are red hot on licence fees (money hungry)

It will be rewritten, but basically we're saying that you can reskin it, but you must seek permission before publishing/distributing it.

If you do a good reskin, we wouldn't say no to its release unless we had a good reason. For example, see William Ivery's Silverton reskins of the 48s - he asked, then worked it up, sent it to Gary; Gary offered some suggestions and assistance, and the reskins (great quality by the way) were subsequently included in the updated 48 pack. No drama.

Squeek - saying you can do a reskin does not exclude asking for permission first. You can't pick and choose the bits of the T&C to suit yourself.

Good call Alltrains. If you ran it just loco and 'vehicle', not only would you get a good water supply, you would also ensure that the train always ends well!

(groans)

Matt
