I was told as long as I add the route names and people
who created the routes to put in the credits and thanks file
I would be alright but the only person
that I couldn't get permission is from Chris Nelson
but that's alright isn't it? I thought of them first
because they allowed me to use there shapes, textures and
terrtex files well at least I'm honest put it that way
And without thinking I added the shapes, textures and terrtex files
by mistake from the routes Sydney West route, Illawarra stage1
route, and Coal Road route I have made contact with these people
for there permission but somehow there emaill addresses isn't
listed anymore so because I have added these files by mistake
I will give a special credit notice for them so hopefully
they won't be upset with me for not adding there names
in the credits and thanks file the readme file is going to be seperated
from the thanks & credit file so that way people can read them
but anyway if they don't like it I will remove my route
from the internet until I work out something like I have
a builder already it's just that I also need the paint shop pro program for the textures but I need version 7 of paint shop pro it seems to be more understanding anyway I believe that my builder from here will do a great
job and I will add him to the credits and thanks file
I have already started on this file but not the readme file until
I have completed my route

If I understand you correctly, without thinking and by mistake, you browsed into three separate Australian routes folders, then into their respective texture and shapes folders. Then by mistake you copied the contents of those folders and mistakenly pasted them into the texture and shapes folders of your route. Then you opened the respective routes .ref file and mistakenly coped the contents of those files and once again by mistake pasted them into the .ref file for your route.

Well yeah something like that
but you see I had to re- install windows and the only thing I made
back up of was the Shapes, Textures, Terrtex and the .Ref files
from my route after I added those files
When I started 2 months ago I asked Mike Simpson on how to
merge two or more routes together but I didn't still
understand his program Route Riter to merge them
and the funny thing is it stuffed up everything bugger me
and I also asked Mike Simpson, Peter Newell and Yuri for some
hints so I got there support too witch is great anyway back to the
subject when I copied those files I forgot that all shapes, textures, terrtex files were on the disk that I had made a zipped folder of
and I don't really feel like doing it all over again I am sure
if the authors have a problem of these routes Coal Road, Sydney West,
and Illawarra stage1 I am sure they will let me know but I rather
hear it from them not anyone else this route will not be for sale
it will be as freeware only and the release date isn't going to be in 2015
it will be earlyer then that guy's either next year sometime
or early 2009 no later then that
cheers

Phil,
Copyright is not just simply listing a persons name in a Credit and Thanks file. You still have to have their permission to use their product (design).
You stated that you asked Peter Newell for permission to use the shapes file from Coals To Newcastle and that he gave you permission. As Peter can only give you permission for the shapes files that he produced how many of the other designers from Coals To Newcastle have you asked for permission to use their designs?

Phil, I think he is only taking the mickey out of you.
How far did you get before you gave up with Adl-Perth? Where did you start?

I started from Sydney I only got as far as Redfern
but I had everything all wrong like I didn't have any
stations or the flying junctions and nothing at all
I was just working with Dynamic track because I didn't
know of the others that I had from when I downloaded
Xtracks and Newroads both end user programs
because I was told that's what I needed for
Mike Simpsons Blue Mountains route
from version 1 now I have version 4 Mike did say
that he was fixing up the Blue Mountains route
I even helped with his route just a little bit of work
I done to it, last time Mike told me he merged my edited
of his Blue Mountains route to a new version you mite have to ask Mike about that so anyway I gave up trying to build the Sydney to Perth route
and I also attempted to build the cityrail network but I gave up on that because I had the terrain worng and now I am working on this one
but I won't give up at all I must build this route it's important to me
and it will be fun and massive to drive on to be honest with you
And yes I got Peter Newell's and Mike Simpson's permission to use everything that I needed to build my route and I have
tried with the other great creators but if these people don't like
me using there shapes they can let me know and I will have them removed and try my best to use the shapes that I have got
there's only afew shapes that I found from Train-sim.com
and I have just edited one of them just a little coke machine
I know it sounds stupid but I didn't like the original textures and I have the Australian flag so I can put it on top of the Sydney Harbour Bridge
and I need a new version of the bridge because the original one is abit worng you see it's attahed to Circular Quay, Wynard, Milsons Point and North Sydney I know I'm always around there either taking photo's or just relaxing
And question was asked about Peter Newell's Coals to Newcastle route
Peter told me to copy the people from his readme file
and paste them into my routes credits and thanks file (Readme file)
I would like to change the textures of all the stations and somehow fix up
the flying junctions because it's also abit worng from what I looked up in the books I have of Sydney Central Station and inclueding on the internet
the flying junctions have arches on each side and some under it
not with bricks stopping track flow I have even tried working out the flying junctions to ad the airport line to Peter Newells coals to newcastle route and it didn't work only Olympic Park worked out it was just for a
test only but when I had to re install windows I lost that bit of Olympic Park I added

Phil, if you use the SydWest Route without getting permission, irrespective of whether you credit the original creator or not, you are leaving yourself open for a copyright lawsuit. And since you've merged that route and haven't got that authorisation, you're in breach of copyright right now.
My suggestion to you would be this:
Get permission from the route creators to use their routes.
Go through their routes and get the permission from the creators of custom content in those routes.
If you do not have the permission of someone and you use their content, even if you got it from soneone else's route, you are in breach of copyright and leaving yourself wide open.

I think you missed understood me
I am only using the Sydney West shapes files
the route I am not merging them at all
I will build it myself in my own route
not merging bro
I have sent the author an email afew times but the email
dosen't go though at all so if the author has a problem
with me using his shape file then he will let me know
not you
and that gos for Illawarra stage1 and coal road routes
I have also made changers to the Illawarra stage1 route
but I cannot get in contact with the author at all
to let him know
and I have made contact with the author of the coal road route
and get no reply I assume Gavin is busy like he said when he started building his route he had a 6 week leave from his job I say he mite work for cityrail or something to do with railways anyway
But I have no doubt that the authors wouldn't mind at all
Like I said I'm not merging them at all
I will build them my way and to the best way as I can and
I have my own marker files from Google earth and google maps
and yes it going to look the same what do you expect bro

Yo Phil.
Some of the files (Which have the name Sydwest in them) were actually made by Ben Johnson himself. (I wouldn't say that he owns copyright as the higher ups like Railcorp and others may have copyrighted the actual infrastructure. Though Ben owns copyright for their MSTS counterparts of the infrastructure, he should've gotten permission from the higher ups first or something..)

As my name is now being used in this discussion thread I want to clarify my involvement.
Phil contacted me and asked my permission to use some of the components of my route.
As I like to encourage people to get involved in the hobby, I have given him permission in "principle", to use the content that I have created, subject to the condition that I review how it is finally used.
I have advised him that as I am not the author of most of the scenery objects in the CTN route, that he will need to seek the authors individual permission.
He has some ambitious plans, but who didn't when they first started. Most of these plans are tempered by experience as we grapple with MSTS.
Phil, I think that your time would be better spent building something that you can share with the community, even if it is only a small start. This, I suspect, will gain you more respect then trying to prove your intentions in this thread.
Looking forward to a finished product.
Cheers
Peter Newell[/quote][/u]

Just remember to still get Ben's permission to use the 3D Models of the buildings, as he made them after spending countless hours using a 3D Modelling program.
The way I see it as this.
1. A Company copyrights a building like a railway station.
2. A person who is making a 3D version of that station for MSTS should contact the company to obtain permission first.
3. A person who wants to use that 3D version of the building into an MSTS route should contact the person who made the 3D version and the company that currently owns the actual building.
Of course, if you're modelling something that's of the past, it's a slightly different ball game with the same point. Meaning that the person who wanted to model a 3D version of a now demolished station should be able to do as they please because obviously, that building has been now demolished. Then go to point 3 but without the bit of contacting the company.
Meaning, permission still needs to be sought.
Make sense?
Buddy.
Daniel Hall.
