I heard today that the Minister may cancel his Visa again, now, this of course means that Djokovic will be back in court again for an appeal, from what I have heard he will try for a stay of proceedings, IF that stay of proceedings does fail, see ya later Novax!!!

When (because I don’t think it’s an ‘if’) the Minister cancels Novax’s visa he will be sure to do it in person, this being the case an appeal via the Administrative Appeals Tribunal will be out of the question, leaving only the legal process through the Federal Court or High Court.

An appeal of the Minister’s personal decision through the courts can only succeed if the courts find that the Minister made an error in law, the decision itself is not in question. Character grounds are very broad in scope, and false, or misleading information supplied in regards to a visa application are quite clear cut.

A Minister’s decision to cancel a visa and therefore remove a non lawful entrant to the country if based on either of those grounds is unlikely to be seen as a legitimate question by either court. This is why you’ve not seen many (any?) successful appeals from criminals deported on character, rappers, boxers and many of the other ‘rich people’ deported on arrival or denied permission to arrive in the first place - and probably none of them faced a charge of false and misleading declarations.
